Freedom of Information - Subcontractor's Clause

1. The Contractor shall in its dealings with [the Authority] use its best efforts to ensure that (a) information considered to be confidential or commercially sensitive and identified as such by the Subcontractor shall be classified as confidential/commercially sensitive by [the Authority] and

(b) [the Authority] shall be required to give notice to the Contractor if any request for information concerning the Contract is made by a third party pursuant to the Freedom of Information Act. The Contractor shall immediately notify the Subcontractor of any such notice received by the Contractor which may affect information relating to the Subcontractor.
