The Builder's Business Pack contains a collection of useful advice and contract templates to help you in your business as a builder or contractor.

In this pack:

  • A Quotation Form with Standard Conditions of Contract for Construction Work
  • A Confirmation of Order Form designed for use when your client agrees to go ahead 
  • A short Form of Subcontract, written as a letter, for use when you take on other firms to provide services to you
  • A form of Collateral Warranty Agreement which, on larger projects, might be required by a bank providing a loan to the client or by purchaser of the completed building.

Standard Terms & Conditions for Construction Work More details...

For use by a Contractor when submitting a Quotation for construction work to a client. A form of Quotation is included together with six pages of Terms & Conditions suitable for building or construction. Together, the documents will create the construction contract.  While reasonably fair, they are biased in favour of the contractor.  Clauses cover such matters as contract formation, general obligations of the contractor and the client, variation, price and payment, insurance, duration, handover and defects, limitation of liability, termination, etc.  Suitable for relatively straightforward construction activities.

 

Collateral Warranty Agreement (Contractor) More details...

For use where a contractor enters into a direct agreement with a purchaser, tenant or funder of a development. A comprehensive document applying current good practice with clauses covering warranties of reasonable skill and care, deleterious materials, intellectual property, insurance, assignment and step-in rights. Accompanied by Explanatory Notes that explain the background and purpose of collateral warranties as well as dealing with individual clauses in the document

Short Form of Subcontract in Letter Format More details...

A user-friendly, very simple agreement in the form of a letter under which a main contractor appoints a subcontractor for certain works.

All the main essentials of a construction contract are present in the 22 paragraphs to which will be attached a schedule setting out the scope of the works etc.
