Terms & Conditions

  1. We, The ContractStore Limited, are publishers of sample contracts and other legal documents. We are not in any way providing legal advice or any legal services. 
  2. Each of the  documents available on our website is sold on the basis that you obtain appropriate legal advice before using it and that you adapt it in order to meet your particular requirements (of which we do not, of course, have any knowledge).
  3. For the above reasons, we wish to emphasise that no document is   sold on the basis that it is fit for any particular purpose or that its terms are legally valid and enforceable in any particular jurisdiction, and all liability in respect of these matters, including liability for economic loss, is excluded.
  4. Copyright in all  documents published by ContractStore belongs to The ContractStore Limited. Copyright in all documents published by Be (or any other publisher) and sold by ContractStore from its website belongs to Be (or that other publisher).
  5. You are not permitted to:
    • sell, lease, sublicence, loan, transfer or otherwise deal in any of the documents purchased online
    • publish any of the documents or any extracts from them on the internet, on any website or in any document which is generally available to the public.
  6. Unless, either when purchasing a document online or subsequently,  you also purchase a Multiple Use Licence, the licence granted to you as  purchaser is  non-exclusive and non-transferable and only permits you to (a)  load the documents on a computer system which is under your control but not onto any networked system involving more than 10 individuals,  (b) print the documents (but not more than 10 copies) for the use of the purchaser within the purchaser's organisation and (c) use the documents in one contract involving a third party.
  7. Multiple copying, use on a computer network with more than ten terminals or more than ten individuaIs having access requires a Multiple Use Licence. 
  8. Because every document purchased from us can be downloaded immediately, no cancellation right exists under the Consumer Protection (Distance Selling) Regulations 2000. We therefore regret that refunds are not normally possible and will only be made in exceptional circumstances. 
  9. The agreement between us is governed by English law and in the event of any dispute you agree to submit to the exclusive jurisdiction of the English courts.

Multiple Use Licence  -  ContractStore documents - Terms & Conditions.

  1. By paying for a multiple use licence fee for any document published by ContractStore,  you will be entitled to reproduce and adapt the document for use in your business for an unlimited number of transactions. This right will also extend to up to 5 ContractStore documents that you purchase and download over a one month period from the date of the first purchase.
  2. If you are a lawyer or other professional consultant, a multiple use licence entitles you to use and adapt the document as a precedent in dealings with your clients.
  3. A multiple use licence is renewable after 12 months from the date of issue.
  4. These terms and conditions are in addition to our General Terms & Conditions set out above.

Multiple Use Licence - Be Collaborative Contract and other documents published by Be -Terms and Conditions.

1. Grant of Licence

This Licence is issued by Collaborating for the Built Environment ("Be") to the Licensee.

2.  Definitions 

The "Licensee"   means the individual or legal entity that either (a) purchased the Licence online from Be or from its distributor ContractStore or (b) purchased a CD-Rom from Be or from Format Publishing. Where the purchaser is an individual purchasing on behalf of a company or organisation, the Licensee is that company or organisation and not the individual.

The "Products" means the Be Collaborative Construction Contract and the Be Product Supply Agreement including, in each case,  Purchase Order, Collaborative Construction Terms, and Guidance Notes and  the Be Guide to Risk Management and including any revised version of any of these documents.       
3. Rights granted

The Licence is non-exclusive and non-transferable and permits the Licensee to:
• load the Products on the Licensee's computer system and onto any networked computer which is under the control of the Licensee
• print the Products or copy them to a computer disc for the use of the Licensee or within the Licensee's organisation and
• use the Products (with or without amendments) in the Licensee's business.

The Licence is granted in respect of any one or more Products purchased by or on behalf of the Licensee during the term of this Licence

 Libraries may use the Products for  research by library users.

4. Term 

The Licence shall continue for twelve months from the date it is issued to the Licensee.  

5. Prohibitions

The Licensee is not permitted to:
• sell, lease, sublicence, loan or otherwise deal in any of the Products
•  publish any of the Products or any extracts from them on the internet, on any website or in any document which is generally available to the public.

6. Copyright

Copyright in the Products belongs to Be. 

Note: The statutory rights of consumers in the UK are not affected by the above  Terms and Conditions.
